Divorce Cases- Indian Divorce Act, 1869 u/s  10 states the following grounds for Divorce in India:

If the spouse:

  • Committed adultery. 
  • Converted his religion.
  • Has been of unsound mind for two years continuously before the filing of the petition.
  • Suffering from some venereal communicable disease for not less than two years.
  • Has not been heard of for the past seven years from the persons who would have heard him
  • Has failed to comply with a decree for restitution of conjugal rights for a period of two years.
  • Deserted the petitioner for at least two years immediately preceding the petition.
  • Treated the petitioner with such cruelty that it created a reasonable apprehension of harm.

Restitution of Conjugal Rights- It implies that if after solemnization of marriage if either party without reasonable excuse withdraws from the society of the other then aggrieved party has the legal right file a case in the Matrimonial Court for ordering him to live with the aggrieved party.

Alimony and Maintenance Cases- While the divorce is underway in the court, the money given by one party (usually husband) to another, on the order of the court, is known as maintenance. Once the two are legally separated, the money paid is known as alimony. This is a legal right of the spouse, especially wives who don’t have and independent source of income and are/were dependent upon husband.

Suits for nullity of marriage – When marriage was constituted on the basis of fraud or incest or there is any other bar on that marriage, the court declares the marriage as a nullity.

Court Marriage- Solemnized under the Special Marriage Act, 1954,it does away with the requirements of rituals and ceremonies of the traditional valid marriages. Court Marriage can be solemnized between an Indian and a foreigner. The parties can directly apply to the Marriage Registrar for performance & registration of marriage and grant of marriage certificate.
